AlphaTheta x Record Store Day Giveaway – Terms and Conditions

Promoter: AlphaTheta EMEA Limited incorporated and registered in England and Wales with company number 9230173 whose registered office is at Unit 39, Tileyard Studios, Tileyard Road, London, N7 9AH, UK (“Promoter”).

In collaboration with (i) Entertainment Retailers Association and (ii) Stichting Nationale Platenbon, trading as “Record Store Day The Netherlands, Belgium, Luxembourg” (together, “Record Store Day”)

1. The Giveaway is open to participants aged 18 years or over who are resident in the UK, Belgium, the Netherlands, Luxembourg, Germany, Switzerland and Austria, where those countries do not prohibit such a promotion. Employees of the Promoter or Record Store Day, their families, agents or any third party directly associated with administration of the Giveaway are not eligible to participate.
2. The Giveaway is free to enter and no purchase is necessary.
3. Participants must:
   1. Follow @recordstoreday on Instagram;
   2. Follow @pioneerdj_emea on Instagram; and
   3. Like the Instagram post posted by @recordstoreday and @pioneerdj_emea in collaboration on Monday March 24th 2025 (together the “Conditions”)
4. The opening date for entries is 4pm on 24 March 2025. The closing date is midnight on 8 April 2025 (the “Closing Date”). Entries received by the Promoter after the Closing Date will be void and will not be entered into the Giveaway.
5. Eligible participants who satisfy all of the Conditions on the Closing Date shall be entered into a random generator where one winner (the “Winner”) and one runner up (the “Runner Up”) will be chosen at random.
6. The Winner will win the following prizes:
   1. 2 x PLX-500 turntables and
   2. 1 x DJM-250 mixer
7. The Runner Up will win the following prizes:
   1. 1 x PLX-500 turntable
8. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
9. The Winner and Runner Up will be notified by direct message from @pioneerdj_emea on Instagram on or before 9 April 2025. If a winner does not respond to the notification within 5 days, the Prize will be forfeited and the promoter will select an alternative Winner/ Runner Up as applicable from the remaining eligible entries in accordance with the process identified above (and that participant will also have 5 days to respond to their notification).
10. Participants may be required to provide further information (such as a full name, email address and delivery address) in order to receive their prizes. The Winner and the Runner Up will receive their prizes within [30 days] of notifying the Promoter of the delivery address.
11. Prizes will only be delivered to addresses in the UK, Belgium, the Netherlands or Luxembourg.
12. Participants may only enter this Giveaway once. All other entries will be void.
13. The prizes set out in conditions 6 and 7 are non-exchangeable, non-transferable and no cash alternative is offered.
14. The Promoter reserves the right, at its sole discretion, to replace any prize or part of a prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
15. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
16. Participants agree that the Promoter may publicise the promotion and the Winners’ and Runner Up’s success (including their names and Instagram handle) with no further recompense.
17. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname (where known) and country of major prize winners to anyone who emails exec.eu@alphatheta.com or writes to Unit 39, Tileyard Studios, Tileyard Road, London, N7 9AH, England (enclosing a self-addressed envelope) within one month after the Closing Date. If a participant objects to any or all of their surname, country and Instagram handle being published or made available, they must contact the Promoter at exec.eu@alphatheta.com as soon as possible after entering. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority or any equivalent authority on request.
18. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.
19. The Promoter reserves the right to hold void, cancel, suspend, or amend the Giveaway where it becomes necessary to do so.
20. Instagram does not sponsor, promote, endorse, guarantee or administrate in any manner this Giveaway, and it is not linked to or associated with the Giveaway. By entering the Giveaway, participants acknowledge and accept this and release Instagram from any claims.
21. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or Runner up or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize or the entrant failing to respond and claim their prizes, except where it is caused by the negligence of the Promoter. Statutory rights are not affected.
22. By entering, participants consent to the processing of their personal data including for processing entries, contacting the Winner or Runner Up and for the purposes outlined in conditions 16 and 17. Personal data supplied during the course of this promotion will only be processed as set out in the Promoter's privacy policy which can be found at https://alphatheta.com/en/company/privacy-policy/.
23. The Promoter reserves the right at any time to modify or discontinue, temporarily or permanently, the Promotion or any prize with or without prior notice due to reasons outside its control, including anticipated, suspected, or actual fraud.
24. Any tax due or payable on any prizes or their value shall be the sole responsibility of the Winner or Runner Up as applicable and the Promoter accepts no responsibility in respect of such taxes or any related filings.
25. These terms and conditions and this promotion are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
